Terms of Use – Bendie Games

Ownership: The intellectual property of The Games, including all Game Materials are the sole property of Bendie Games. All rights are reserved.
Copyright: The Games, including all Game Materials are original content produced by Bendie Games and copyright protected under New Zealand law. The Games, including all Game Materials must not be edited, modified, adapted, reverse engineered, used for derivative works or reproduced (other than for purposes explicitly mentioned in item 4.) without prior written agreement with Bendie Games.
Use by Artificial Intelligence: Artificial Intelligence, Language Learning Models or any programmed entity is not allowed access to The Games or any Game Materials for any purposes whatsoever (including reading, learning, training or reproducing). Users must be human and are not permitted to upload or otherwise present The Games or any Game Materials to any Artificial Intelligence, Language Learning Models, database or programmed entity.
Product: Bendie Games provides game ideas in the form of digital Game Materials only. No physical products are provided to the User. Game Materials are provided in PDF format and require further setup by the User. Setup may require printing of Game Materials by the User as well as User Provided Items and Property. By purchasing or otherwise receiving The Games, the User acknowledges that they are aware of the nature of The Games and agree to all Terms of Use.
Refunds: Once a purchase is made, it cannot be refunded, exchanged, or returned. All purchases of The Games are final and non-refundable.
Printing and Use: Users are permitted to print unlimited copies of the Game Materials. The Games and Game Materials may be used for personal, non-commercial, non-profitable purposes only. Printed materials must not be distributed for any purpose other than required to play The Games. The Games and Game Materials must not be used for commercial or profitable use without prior written agreement with Bendie Games.
Quality of Printed Materials: Bendie Games is not liable for the quality of printed Game Materials or any costs or resources used in printing. The quality, cost and resources used in printing Game Materials is the sole responsibility of the User and will vary depending on the equipment and options used. The quality of the game experience may vary depending on the quality of the printed materials.
User Provided Items and Property: The User is solely responsible for providing any User Provided Items and User Provided Property suggested in the Game Materials. Bendie Games is not liable for costs, availability, quality, or variations in User Provided Items and User Provided Property, or the quality of game experience that may result. Any items or property listed in the Game Materials as a requirement to play The Games are generalised suggestions for best game experience only. Users are responsible for sourcing and judging suitability of User Provided Items and Property prior to playing The Games.
Damages: Bendie Games is not liable for any damage or loss to User Provided Items, User Provided Property or any other personal property or public property that may occur while setting up or playing the Games.
Safety: The User acknowledges that they are solely responsible for the safety and conduct of any other persons in their direct vicinity (i.e. guests) when playing The Games, and will take all practicable steps to ensure The Games are played in a safe manner. Bendie Games is not liable for any personal injury or loss suffered as a result of setting up or playing The Games.
Age and Ability: The Games are intended for use by normally abled persons of at least 13 years of age. Age or ability recommendations are not provided for each specific Game. Users must use their own discretion and judgment of suitability before allowing a minor or person with disability to play The Games.
No Unlawful Use: Users must not use The Games or any Game Materials for any unlawful purpose or use in any public demonstration or other acts that could defame or harm Bendie Games or any other person or entity.
Governing Law: The Games are intended for sale in New Zealand only, and therefore these Terms of Use are governed by the laws of New Zealand. Any disputes relating to these terms or Bendie Games will be subject to the jurisdiction of the courts of New Zealand only.

Definitions:

“Bendie Games” refers to Bendie Games Limited Liability Company, New Zealand.
“The Games” refers to any original game design produced by Bendie Games.
“User” refers to any individual who receives a Game from Bendie Games.
“Game Materials” refers to any materials provided by Bendie Games for use in The Games, including but not limited to rules, setup guides, characters, stories, game specific components, or user created game items for use in The Games.
“User Provided Items” refers to any additional items suggested in the Game Materials as a requirement to play The Games, including but not limited to: personal belongings, household items, or store-bought products.
“User Provided Property” refers to any property, building, premises or spaces which The User possesses ownership or permission of use for playing The Games.
